A Union volunteer, who was discharged for promotion into a USCT unit is charged with illegally taking his arms and equipment with him to his new assignment, 1p. folio, manuscript affidavit, by Capt. William M. Rumery, "Camp 2d Mass. Vol. Cavalry, In The Field, February 14, 1865", reading, small in part: "…Otto Von Borries, a private of my Co. (H), 2nd Mass. Vol. Cavalry left the company while it was stationed at Vienna, Va…August 2nd 1864 and still remains absent under the provisions of that order…he took with him the following Ordnance store, viz. One Colts Rev. Pistol, One Pistol Holster…One Pistol Pouch & Pick, One Sabre Belt & Plate. The money…has been charged upon the muster & pay rolls…he having never returned them to me…the remainder of his arms & equipments he left in his tent without having turned them over to me…Wm. Rumery, Capt. 2d Mass. Cavalry Vols. David Huston being duly sworn deposes and says that he is cognizant of the facts…and that they are true to the best of his knowledge…". Von Borries was discharge for promotion into the 119th United States Colored Troops at Camp Nelson, Ky. on January 10, 1865. He remanded in the regiment until his discharge in 1866 as quartermaster. Near fine.
