Texas, July 4, 1854, and reads in part: “...last Sunday evening a man was murdered here in this town by the name of Charles H. Peabody by a man by the name of Weston. Said Peabody was guilty of trying to get to bed to a free mulato girl in the chamber of M. Husbands. Whilst Weston heard him ran & drew his pistol & P. said Mr. Weston dont shoot this is Mr. Peadoby I will acknowledge my faults. & Weston let him go. On Sunday Peabody went to Weston’s house & says Mr. Weston we have some difficulty & I want you to say at what time we shall settle it. Weston says right now drew his pistol & fired at him missing him. P drew his pistol & snapped at Weston & then threw his pistol at him but missed. Weston ran back in the house & got another pistol ran up to P & says he here is what never fails fired it off shooting P through the back the bullet ranging into his heart which killed him instantly. P was a wealthy man he had a jewelry shop. Weston was a poor man & not going to be run over. But some of the men think no more of killing a man here then you would of killing a hog...” Fine condition.
