Manuscript Document, being a Sheriff's statement of a levy executed against a defendant in a Court case; 5pp., the first and last sheets of which measure 8" by 9", the others 8" by 12", County of Calhoun, December 13, 1858. The first page bears a little nick on the right margin, else Extremely Fine. Here the Sheriff appraises the value of slaves, subject to replevin, but left with their owner on trust. In part: "...I went to the house of said Claiborne Hill with the execution, and a memorandum of the names of the slaves in controversy and found Mr. Claiborne Hill there. I saw some of the negroes about the house and told Mr. Claiborne Hill that I had an execution to levy upon the negroes, and reading over the names, I asked him...whether the names were right and replied that they were. I told Mr. Claiborne Hill that I had come to levy the execution upon them, but that he might replevy them if he wished, as the law allowed him that privilege. I cannot say exactly what the negroes in controversy were worth, but I valued them at that time...at twenty five hundred dollars. I consider the valuation of the negroes...fair and reasonable...I did not see all the negroes in controversy when I made out the levy. I did not see the girl Ellen age about fourteen. I did not take any of the negroes in my possession...but left them with Mr. Claiborne Hill, informing him, that under the law they could be replevied within a certain time...I merely took him at his word that he would deliver the negroes..."
