A good war-date Confederate muster roll, partly-printed 2pp. oblong legal size folio, being a, "Return of Captain James M. Mayo's Company "E", of the 36th Regiment of N. C. State Troops (Artillery)àfor the month of January 1862." Dated January 31, 1862, their station was Fort Ellis, Newbern, North Carolina and shows that there was 127 present for duty at the post. No doubt this document was a battlefield "trophy" from the New Bern Battlefield of March 14, 1862 since it was found in the military collection of Sgt. Henry J. Bardwell of the 27th Massachusetts Vols. The 27th moved against the fort during the battle and it is known that many soldiers scavenged the battlefield after the Confederate evacuated the ground. Fort Ellis was constructed four miles south of New Bern on the southern bank of the Neuse River as an earthwork fortification mounting one 8-inch Columbiad and seven 32-pounder cannons for defense of New Bern. The fort was garrisoned by Company E, 36th North Carolina Regiment and named in honor of North Carolina Governor John W. Ellis. Later the 36th served as the main garrison force under the command of their Col. William Lamb at Fort Fisher. They fought valiantly in both the First and Second battles of Fort Fisher.
